Terms of Service

Agreement

These Terms of Service ("Terms") govern your access to and use of Bloomly (the "Service"). By creating an account or using the Service, you agree to these Terms. If you don't agree, please don't use the Service.

Bloomly is currently in public beta. Features may change, behavior may occasionally be inconsistent, and data models may evolve. We'll do our best to make transitions smooth.

Acceptable use

You agree not to:

  • Use the Service for anything illegal or harmful.
  • Attempt to access other users' accounts or data.
  • Reverse-engineer, decompile, or attempt to bypass security controls.
  • Interfere with, disrupt, or overload our infrastructure.
  • Use the Service to send spam, malware, or unlawful content.
  • Scrape or copy substantial portions of the Service without permission.

Your account & responsibilities

You're responsible for maintaining the confidentiality of your login credentials and for all activity that happens under your account. Notify us immediately at support@bloomly.app if you suspect unauthorized access.

You must be at least 13 years old (or the minimum age required in your country) to use Bloomly. You are responsible for the accuracy of the information you provide.

Your content

You retain all rights to the content you create in Bloomly — habits, goals, reflections, notes, and everything else. By using the Service you grant us a limited license to store, process, and display that content solely to provide the Service to you.

Subscription & premium features

Bloomly offers optional premium features. Premium access is granted manually by our team after we verify a supported payment (currently BCL / WhatsApp). Premium status is stored on your profile and is protected — it cannot be modified by client-side code.

Premium status is tied to your account. Refunds are handled case-by-case; please contact support@bloomly.app within 14 days of your payment if you'd like to request one.

We may adjust the set of features included in premium during the beta. If we make a material change that reduces the value of your subscription, we'll offer a fair accommodation.

Intellectual property

The Bloomly name, logo, design, code, and content (excluding your own content) are owned by us or our licensors and are protected by copyright and other laws. You may not copy, modify, or create derivative works from the Service except as permitted by these Terms or by law.

Beta software disclaimer

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

During the beta period, we do not guarantee uninterrupted availability, feature stability, or that data models will remain unchanged. Always keep your own copy of anything critical (Settings → Data → Export).

Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BLOOMLY AND ITS OPERATORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE.

Our aggregate liability for any claim relating to the Service shall not exceed the greater of the fees you paid to us in the twelve months preceding the claim, or USD $50.

Termination

You may stop using the Service at any time by signing out or deleting your account. We may suspend or terminate accounts that violate these Terms, or if required by law. On termination, we remove your synced data within 30 days, except where we are required to retain it.

Changes to the Service and these Terms

We may modify or discontinue features at any time. We may update these Terms; when we do, we'll update the "Last updated" date above and, for material changes, notify you in-app. Continued use of the Service after changes means you accept the updated Terms.

Governing law

These Terms are governed by the laws of the jurisdiction in which the Service operator is based, without regard to conflict-of-law principles. You agree to the exclusive jurisdiction of the courts located there for any dispute arising out of or relating to the Service.
